Civil Claims with PIAB/InjuriesBoard.ie
The InjuriesBoard.ie is a statutory government body which provides assessment of personal injury compensation for victims of workplace, motor and public liability accidents.
We can assist with the processing of such claims and advising on any offer that may be made. It is important to note that the normal timeframe within which you must make a claim is limited by law to two years from the date of the accident. There are exceptions to this for persons under 18 years of age and some other categories of cases, but legal advice should be sought.
Once a claim has been lodged the other party will be notified and they have 90 days to confirm whether or not they consent to the assessment of your claim by the Injuriesboard.ie. If they receive consent from the respondent they will proceed with the assessment of your claim.
If the Respondent does not consent to the assessment of your claim the Injuriesboard.ie will issue an Authorisation permitting you to pursue your claim through the court system.
If they proceed with the assessment the Injuriesboard.ie will let you and the Respondent know in writing the amount of the Assessment, i.e. the level of compensation being awarded. You have 28 days from the date of receipt of the notice of Assessment to confirm in writing whether you accept or reject the Assessment.
If you accept the Assessment, you must acknowledge this in writing to InjuriesBoard.ie. If the Respondent also accepts the Assessment they will issue an ‘Order to Pay’. This has the same status as an award of Court. If they do not receive your reply in writing within the 28 days, you will be deemed to have rejected the Assessment.
If either of the parties reject the assessment then they will issue an Authorisation which allows you pursue your claim through the court system.
